TERMS OF USE
Seller: IK MiniBRO, registration number 40002228914, legal address: Jelgava, Puķu iela 5 - 94, LV-3001, hereinafter – Online Store – provides the content available on the website and sells goods in accordance with the Terms of Use set forth below.
1. General Provisions
1.1. If a consumer purchases goods through the website, such a mutual agreement is considered a Distance Agreement and is subject to the legal norms of the Republic of Latvia (Consumer Rights Protection Law, Cabinet of Ministers Regulations No. 255 "Regulations on Distance Contracts", etc.).
1.2. By placing an order on the website xvibe.lv, the Buyer confirms that they have fully read and agree to these Terms.
2. Making a Purchase
2.1. The prices and specifications of the products are indicated next to the products. All prices are stated in euros (EUR) and include VAT.
2.2. To make a purchase, the Buyer adds the goods to the cart, provides the delivery data, and selects the delivery method.
2.3. The total cost of the order (product + delivery) is displayed before the payment is made.
3. Payment Terms
3.1. The settlement currency on the site is the euro (EUR).
3.2. Payment collection and processing are provided by the payment solution Klix (AS Citadele banka).
3.3. The Buyer can make payment using Klix Pay by bank direct bank payments from bank accounts in Latvia, Lithuania, and Estonia.
3.4. Personal data necessary for making payments is transferred to AS Citadele banka for secure transaction processing.
3.5. The agreement between the Buyer and the Online Store is considered concluded at the moment when the payment has been successfully made and received in the Online Store's bank account.
4. Delivery Terms
4.1. Goods are delivered to European Union member states using parcel machine networks or courier mail.
4.2. Delivery time: 3–20 business days. If the delivery of goods is delayed due to circumstances beyond the control of the Online Store, the Buyer will be informed. The maximum delivery period is 45 days.
4.3. Delivery costs are covered by the Buyer in accordance with the selected rate at the time of placing the order.
5. Right of Withdrawal and Special Conditions
5.1. The Buyer (a natural person) has the right to withdraw from the product within 14 calendar days after receiving it.
5.2. Hygiene Goods Exception: In accordance with Clause 22.5 of Cabinet Regulation No. 255, the right of withdrawal cannot be exercised for goods which are not suitable for return due to health protection or hygiene reasons if their packaging has been opened after delivery. (Applies to adult toys, hygiene items, etc.).
5.3. Goods that are eligible for return must be sent back undamaged and in their original packaging within 14 days after sending the withdrawal notification.
5.4. The Buyer shall bear all direct costs associated with the return of the goods.
5.5. The Online Store shall refund all payments received from the Buyer (including standard delivery charges) within 14 days after receiving the goods back and inspecting them. Refunds are made to the same bank account from which the payment was made.
6. Warranty and Claims
6.1. The Online Store provides the statutory 2-year warranty for non-conformity of the goods with the terms of the contract (for natural persons).
6.2. Please send complaints regarding the quality of the goods to the e-mail: info@xvibe.lv. A response will be provided within 15 days.
7. Personal Data Security
7.1. Customer data is processed in accordance with the General Data Protection Regulation (GDPR). 7.2. Data is used only for order identification, delivery of goods, and communication with the customer regarding the order status.
8. Dispute Resolution
8.1. All disputes shall be resolved through negotiations. If an agreement cannot be reached, the Buyer has the right to contact the Consumer Rights Protection Centre (PTAC) or use the European Union ODR platform: https://ec.europa.eu/consumers/odr/.
